Terms of Service.

These Terms govern access to and use of PerformancePal, the website, waitlist, and related services provided by BETTER PRACTICE LLC.

Agreement and Eligibility
By accessing or using PerformancePal, you agree to these Terms and the Privacy Policy. You must be at least 16 years old, or the higher age required for independent digital consent where you live. Children under 13 are blocked. If you do not meet these requirements or do not agree, do not use the service.

Service and License
BETTER PRACTICE LLC grants you a limited, personal, revocable, nonexclusive, nontransferable license to use PerformancePal for lawful consumer wellness and fitness purposes on supported Apple devices. The app’s bundle identifier is com.naynaygoldberg.lifescore. Features may change, be suspended, or be discontinued, and some features depend on device capabilities, permissions, connectivity, third-party services, or region.

Wellness Only; No Medical Care
PerformancePal is not a medical device and does not provide diagnosis, treatment, prescriptions, emergency monitoring, or medical advice. Scores, recovery or strain summaries, nutrition information, workout guidance, habits, journal prompts, and other outputs are general wellness and fitness information only.
Do not ignore professional advice or delay seeking care because of the app. If you believe you may have an emergency, contact emergency services. BETTER PRACTICE LLC is not a HIPAA covered entity or business associate merely because the app handles wellness information.

Apple Health and User Data
You choose whether to grant Apple Health permissions and are responsible for the devices, data sources, and settings you connect. You represent that information you enter, upload, scan, or import is yours or that you have permission to use it.
Health data, daily scores, sleep, recovery, strain, food, pantry, recipes, workouts, habits, water, journal entries, and document information may be incomplete or inaccurate. Review information before relying on it and confirm scanned health-document information before allowing updates.

AI, Coach, and Daily Outlook
Coach and Daily Outlook use AI-generated language. Outputs may be incorrect, incomplete, outdated, or unsuitable for your circumstances. They are not professional medical, nutrition, mental-health, legal, or financial advice.
You are responsible for evaluating AI output and for the decisions and actions you take. Do not submit unlawful content or information you do not want processed to generate a response.

Accounts and Acceptable Use
Keep account and device access secure and provide accurate information. You may not misuse the service; violate law; infringe rights; attempt unauthorized access; introduce malware; scrape or reverse engineer except where law permits; interfere with security or operation; impersonate others; or use PerformancePal to provide regulated medical services.
We may investigate misuse, restrict features, suspend access, or terminate accounts when reasonably necessary to protect users, the service, or legal rights.

Waitlist, Email, and SMS
If you join the waitlist, you may consent to receive product updates from BETTER PRACTICE LLC by email and, if separately selected, recurring automated SMS messages about PerformancePal sent using Brevo. Consent to marketing texts is not a condition of purchase. Message and data rates may apply.
You may unsubscribe from email at any time. For SMS, reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. Contact performancepal.support@gmail.com for support.

Ownership and Third-Party Services
PerformancePal, its software, branding, content, and documentation are owned by or licensed to BETTER PRACTICE LLC and protected by law. You retain rights in content you submit and grant us the limited rights needed to host, process, display, and use it to provide and improve the service. Apple Health, iOS, Brevo, data sources, and other third-party services are governed by their own terms; we are not responsible for third-party availability or conduct.

Disclaimers and Liability
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, noninfringement, uninterrupted availability, or results. BETTER PRACTICE LLC and its members, managers, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, health outcomes, or business opportunity. Any aggregate liability will not exceed the greater of amounts you paid for the service during the twelve months before the claim or one hundred U.S. dollars, except where law requires otherwise.

Termination, Law, and Contact
You may stop using PerformancePal at any time and may request account deletion. We may suspend or terminate access for violations, risk, or discontinuation. Provisions that should survive will survive. These Terms are governed by Colorado law, without regard to conflict-of-law rules. Exclusive venue will lie in state or federal courts serving Denver, Colorado, unless applicable consumer law requires otherwise. Before filing a claim, contact us and allow a reasonable opportunity to resolve it.
