BETTER PRACTICE LLC is a Colorado limited liability company and the controller of personal information described in this Policy. PerformancePal is the product name only and is not a separate company or DBA. This Policy applies to the PerformancePal iPhone app, related websites, waitlist communications, and support interactions.
We may collect account and contact information; age or eligibility confirmations; support messages; device, app-version, diagnostic, security, and usage data; and information you choose to enter, scan, import, or create in PerformancePal. Product data may include Apple Health data you authorize, daily scores, sleep, recovery, strain, workouts, nutrition and food records, barcode or search activity, pantry and recipe information, habits, water, journal entries, widgets, and health-document scans. Document information is presented for your confirmation before it updates app data. Our Brevo waitlist may collect email address, mobile number, signup source, consent records, and communication preferences.
We use information to operate and improve PerformancePal; calculate and display wellness summaries; provide nutrition, workout, habit, journal, widget, and Live Activity features; generate Coach and Daily Outlook language; process user-confirmed document updates; personalize the experience; answer support requests; prevent fraud or misuse; maintain security; comply with law; and send email or SMS product updates when you consent.
PerformancePal provides consumer wellness and fitness information only. We do not use app information to diagnose, treat, cure, or prevent disease, and the app is not a medical device.

Apple Health, AI, and Sensitive Data
PerformancePal accesses Apple Health information only after you grant permission. You can review or revoke those permissions in Apple Health or iOS settings. Availability and accuracy depend on your devices, sources, permissions, and data quality.
We do not sell your personal
information.
Coach and Daily Outlook use AI-generated language. Inputs and relevant context may be processed to produce a response, and outputs may be incomplete, inaccurate, or inappropriate for your circumstances. Do not submit information you do not want processed. Health and wellness information may be sensitive; choose carefully what you enter or connect.
We retain information only as long as reasonably necessary for the purposes described here, including providing the service, maintaining security, resolving disputes, enforcing agreements, and meeting legal obligations. Waitlist records may be retained until you unsubscribe, opt out, or request deletion, subject to suppression records needed to honor your choice.
We use reasonable administrative, technical, and organizational safeguards, but no system, transmission, or storage method is completely secure. You are responsible for protecting your device, credentials, and backups.

HIPAA, Transfers, and Policy Changes
BETTER PRACTICE LLC is not a HIPAA covered entity or business associate merely because PerformancePal handles wellness information. Information may be processed in the United States and other locations where service providers operate, subject to applicable safeguards. We may update this Policy as the product, vendors, or law changes; the updated date will appear above, and material changes may be communicated through the service or contact information you provided.
